Evidence of the Presence of Benzene in Dry Shampoos
In 2021, high levels of benzene were detected in aerosol spray deodorants. This prompted the FDA to alert the industry that it may need to conduct testing on any cosmetic product that uses an aerosol propellant. Some manufacturers begin conducting their own tests and issuing voluntary recalls.
The Valisure Study
On November 1st, 2022, Valisure, L.L.P., released the result of a study wherein it conducted an independent test of 148 different dry shampoo products from 34 different popular manufacturers and found that over 70% of the products tested contained benzene. Many of these were far higher than the 2 parts per million that the FDA considers the ceiling for safety levels in drugs. (Dry shampoo is not a regulated drug but defined as a cosmetic by the FDA.) The results of the study were so alarming that they filed a Citizen’s Petition with the FDA asking that a recall be issued for certain dry shampoos. Valisure is a company that conducts tests on various products and medications to determine whether they meet regulatory standards.
What Brands of Dry Shampoo Were Found to Have Benzene Over 2 PPM?
According to the Valisure, L.L.P. Citizen’s Petition to the FDA, the following brands had products with lots that tested above the 2 PPM benzene level:
- Not Your Mother’s
- Paul Mitchell
- Sun Bum
- dp Hue
- Sol de Janeira

Dry Shampoo Class Action Lawsuits and Recalls
Several class actions have sprung up over the recent recall of various dry shampoo products and the results of Valisure’s findings. A class action against Unilever United States, Inc. was filed on November 2, 2022, alleging that certain dry shampoo products such as Dove, Nexxus, TIGI, Suave, and Tresemme were sold containing unsafe levels of benzene. In October of this year, Unilever issued a voluntary recall of these products. Johnson & Johnson, Inc., maker of Sun Bum, Paul Mitchell, and Batiste dry shampoos, was also hit with a proposed class action lawsuit over dry shampoo products on November 14, 2022. Also filed in early November 2022, was a class action lawsuit against Not Your Mother’s brand dry shampoo.
Benzene is a Class 1 Solvent that, according to the FDA “should not be employed in the manufacture of drug substances, excipients, and drug products” due to its “unacceptable toxicity.” If use is unavoidable, then the FDA acknowledges that levels should be restricted. For regulated pharmaceuticals, the acceptable maximum level is 2 parts per million (ppm). While dry shampoos are not a pharmaceutical, exceeding 2 ppm is clearly not advisable. In some of the tested dry shampoo lots, benzene levels greatly exceeded the maximum amount for drugs. For example, Not Your Mother’s Beach Babe Texturizing Dry Shampoo-Toasted Coconut 7 oz was found to have a benzine concentration of 158 ppm on the first spray. Benzene is a known carcinogen that can cause cancer in humans in the form of leukemia and other blood cancers.
