A two year statute of limitations begins from the date of the death and is absolute.
Texas Law gives the surviving spouse, children and parents of a wrongful death victim, the right to bring a cause of action against those who are responsible for the death. This right is granted where the deceased would have had the right to bring the cause of action himself, had he not passed away. This statute can be found in the Texas Civil Practice and Remedies Code, Chapter 71.
