Houston Texas Wrongful Death Lawyers
Wrongful Death Attorney Houston
If your spouse, parent or child has been killed and you suspect that their death was the unnecessary consequence of someone else’s negligence, you have the right to have an attorney look into the circumstances. It is very important that you speak to one of our lawyers quickly so that the investigation team can begin before evidence disappears or is destroyed.
A three month window exists wherein only surviving children and spouses can file a wrongful death suit following a loved one’s death. If after the three months is up the surviving children and spouse have not filed a claim in the decedent’s name, the executor of the estate can then file a suit on behalf of the beneficiaries (spouse, children, and dependants). A two year statute of limitations begins from the date of the death and is absolute.
Texas Law gives the surviving spouse, children and parents of a wrongful death victim, the right to bring a cause of action against those who are responsible for the death. This right is granted where the deceased would have had the right to bring the cause of action himself, had he not passed away. This statute can be found in the Texas Civil Practice and Remedies Code, Chapter 71.
Wrongful death claims can arise from virtually any type of personal injury claim resulting in death including:
- Automobile accident
- Work injury
- Dog attack
- Medical malpractice
- Nursing home neglect
- Maritime injury
- Products liability
- Premises liability
