How Long Do I Have to File a Personal Injury Claim?

States have different deadlines for a plaintiff to file a lawsuit. This deadline is called the Statute of Limitations. In the State of Texas, the general rule  is two years.  However, there are many exceptions including the following:

  • The discovery rule. A rule that extends the time period on repressed injuries and hard-to-discover injuries until the harm and cause can reasonably discovered.
  • Minors.  Minors are given until their 20th birthday to file claims.
  • Defendant leaves the state.  When a tortfeasor leaves the state before the 2-year statute runs, this can be grounds for an extension.
  • 1st party insurance claims.  Claims against your own insurance may have a 3 or 4 year statute of limitations depending upon what the contract states.
  • Other exceptions.  There are other exceptions that can apply in certain circumstances so it is important that you consult an attorney about your specific facts.
