Apple AirPod Hearing Loss Lawsuits and Amber Alerts

Have you heard about the Apple AirPod lawsuits alleging permanent damage and hearing loss as the result of using Apple AirPod wireless earbuds when an amber alert just happened to go off?  Apple has, and apparently, the lawsuits are not their first time hearing about it per the claims. According to one of the lawsuits Apple has received at least 1538 complaints about the lack of decibel control of the Apple AirPods when alerts go off since 2019.  If you or your child suffered from ear damage or hearing loss while using Apple AirPods when an Amber Alert went off, talk to a lawyer about an Apple AirPod Lawsuit today.  Call Simmons and Fletcher, P.C., for more information on connecting with an injury lawyer about your ear injury from an Apple AirPod wireless earbud at 800-298-0111. The lawsuits allege that Apple AirPods had a product defect at the time of injury in that there was no safety mechanism to turn down the elevated decibels at which Amber Alerts are broadcast by the Apple iPhones and there is no warning given to consumers of this problem. If Apple had placed a warning on the box of AirPods stating something like “in the event of an Amber Alert you could suffer permanent hearing loss and/or ear drum damage,” they would have likely had a lot less sales.

Updates since the injuries alleged in the lawsuits have added the ability to turn Amber Alerts off. However, even so,  not everyone is aware of this feature nor why it is important.

In one of the lawsuits, a San Antonio, Texas family field an Apple AirPod hearing loss lawsuit after their son allegedly suffered permanent hearing loss while watching and listening to Netflix using the Apple AirPod wireless earbuds when suddenly, an amber alert went off, the sound decibels instantly shot up tearing his eardrum and causing permanent injury in his ear. The boy was only 12 years old and is now alleging that he has permanent hearing loss due to the defect. The lawsuit is Gordoa v. Apple Inc et al, U.S. District Court, Northern District of California, No. 3:22-cv-02900.

Potential Injuries By AirPod Users

There have been several injuries alleged in the lawsuits related to hearing loss due to excessively loud Alerts as well as online and in complaint forums regarding the use of the Apple AirPods when alerts went off.  These include:

  • Eardrum rupture
  • Noise-induced hearing loss
  • Tinnitus (persistent ringing in the ears)
