The lawsuits allege that Apple AirPods had a product defect at the time of injury in that there was no safety mechanism to turn down the elevated decibels at which Amber Alerts are broadcast by the Apple iPhones and there is no warning given to consumers of this problem. If Apple had placed a warning on the box of AirPods stating something like “in the event of an Amber Alert you could suffer permanent hearing loss and/or ear drum damage,” they would have likely had a lot less sales.

Updates since the injuries alleged in the lawsuits have added the ability to turn Amber Alerts off. However, even so,  not everyone is aware of this feature nor why it is important.

The boy was only 12 years old and is now alleging that he has permanent hearing loss due to the defect. The lawsuit is Gordoa v. Apple Inc. et al, U.S. District Court, Northern District of California, No. 3:22-cv-02900.
